装修业务涉税处理,看这篇!

不管你是买房子、租房子,总是绕不开装修。而关于装修的税收问题,你又知道多少呢?

一、增值税

装修服务,属于建筑服务中的装饰服务,当前适用的增值税税率为9%。

需要特别注意的是,物业服务企业为业主提供的装修服务,按照“建筑服务”缴纳增值税,适用税率9%;而物业管理服务,按照“现代服务-商务辅助服务”缴纳增值税,适用税率6%。

(虽然都是物业公司提供的服务,实质却是完全不一样呢!)

政策指路:《关于明确金融 房地产开发 教育辅助服务等增值税政策的通知》(财税〔2016〕140号)第十五条规定:物业服务企业为业主提供的装修服务,按照“建筑服务”缴纳增值税。

二、企业所得税

问:企业发生的装修支出,可不可以一次性列支呢?

答:不可以。如果是对租入的房屋进行装修,应作为长期待摊费用按照规定摊销;如果是对自有的房屋进行装修,应并入房屋的固定资产计税基础计提折旧。

政策指路:(1)《中华人民共和国企业所得税法》第十三条规定:在计算应纳税所得额时,企业发生的下列支出,作为长期待摊费用,按照规定摊销的,准予扣除:……(二)租入固定资产的改建支出。

(2)《国家税务总局关于企业所得税若干问题的公告》(国家税务总局公告2011年第34号)第四条规定:

如属于提升功能、增加面积的,该固定资产的改扩建支出,并入该固定资产计税基础,并 从改扩建完工投入使用后的次月起,重新按税法规定的该固定资产折旧年限计提折旧,如该改扩建后的固定资产尚可使用的年限低于税法规定的最低年限的,可以按 尚可使用的年限计提折旧。 

三、个人所得税

个人转让住房时,支付的住房装修费用可以在缴纳个人所得税时作为合理费用扣除。但是应提供实际支付装修费用发票,并且发票上所列付款人姓名与转让房屋产权人一致。

同时,可扣除的装修费用有上限:

①已购公有住房、经济适用房:最高扣除限额为房屋原值的15%;

②商品房及其他住房:最高扣除限额为房屋原值的10%。

要注意的是,一套房屋的装修费用只能扣除一次。也就是说,如果之前你购入的房屋就为装修房,即合同注明房价款中含有装修费(铺装了地板,装配了洁具、厨具等)的,之后再转让,就不得再扣除装修费用了哦。

政策指路:《国家税务总局关于个人住房转让所得征收个人所得税有关问题的通知》(国税发〔2006〕108号)第二条规定:对转让住房收入计算个人所得税应纳税所得额时,纳税人可凭原购房合同、发票等有效凭证,经税务机关审核后,允许从其转让收入中减除房屋原值、转让住房过程中缴纳的税金及有关合理费用。第二条第三项规定:“合理费用是指:纳税人按照规定实际支付的住房装修费用、住房贷款利息、手续费、公证费等费用。

四、房产税

企业对自有房屋进行装修,属于与房屋不可分割、不可移动的部分,应并入房产原值缴纳房产税。

政策指路:根据《国家税务总局关于进一步明确房屋附属设备和配套设施计征房产税有关问题的通知》(国税发〔2005〕173号)第二条规定:为了维持和增加房屋的使用功能或使房屋满足设计要求,凡以房屋为载体,不可随意移动的附属设备和配套设施,如给排水、采暖、消防、中央空调、电气及智能化楼宇设备等,无论在会计核算中是否单独记账与核算,都应计入房产原值,计征房产税。

五、土地增值税

问:现在市面上很多新房都是精装房,那么对于精装房的装修部分,可否作为土地增值税的扣除项目呢?

答:可以的。对于房地产开发企业,如果销售已装修的房屋,其装修费用可以计入房地产开发成本,作为土地增值税的扣除项目。

政策指路:《国家税务总局关于房地产开发企业土地增值税清算管理有关问题的通知》(国税发〔2006〕187号)第四条规定:土地增值税的扣除项目:……(四)房地产开发企业销售已装修的房屋,其装修费用可以计入房地产开发成本。

六、印花税

问:签订装修合同是否需要缴纳印花税呢?

答:需要。普通房屋的装修合同,应按照“加工承揽合同”缴纳印花税。

政策指路: 根据《中华人民共和国印花税暂行条例》(国务院令第11号)附件《印花税税目税率表》规定:“加工承揽合同包括加工、定作、修缮、修理、印刷、广告、测绘、测试等合同。立合同人按加工或承揽收入万分之五贴花。”
